Agreement to Terms

By using FibeFly's services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

Service Description

FibeFly provides:

  • High-speed fiber-optic internet service
  • Cable television programming
  • Digital phone service
  • Related equipment and technical support

Service Availability

Services are subject to availability in your area. We strive to provide reliable service but cannot guarantee 100% uptime due to factors beyond our control, including weather, power outages, or network maintenance.

Account Responsibilities

You are responsible for:

  • Maintaining accurate account information
  • Protecting your account credentials
  • All activities that occur under your account
  • Timely payment of all fees and charges
  • Proper use of equipment provided by FibeFly

Acceptable Use Policy

You agree not to use our services for:

  • Illegal activities or activities that violate others' rights
  • Sending spam or unsolicited communications
  • Hacking, phishing, or other cybersecurity threats
  • Excessive bandwidth usage that impacts other customers
  • Operating servers for commercial purposes (residential plans)

Payment Terms

Monthly service fees are due in advance. Late payments may result in service suspension or termination. A reconnection fee may apply if service is suspended for non-payment. All prices are subject to change with 30 days' notice.

Equipment

Equipment provided by FibeFly remains our property. You are responsible for its care and must return it in good condition upon service termination. Damaged or unreturned equipment will result in replacement charges.

Service Level Agreement

We target 99.9% network uptime. Scheduled maintenance will be announced in advance. Service credits may be available for extended outages as outlined in your specific service agreement.

Termination

Either party may terminate service with 30 days' written notice. We may terminate service immediately for violation of these terms, non-payment, or fraudulent activity. Early termination fees may apply to contract customers.

Limitation of Liability

FibeFly's liability is limited to the monthly service fee. We are not liable for indirect, incidental, or consequential damages. This limitation applies to the fullest extent permitted by law.

Privacy and Data

Your use of our services is subject to our Privacy Policy. We collect and use data as described in our Privacy Policy to provide and improve our services.

Changes to Terms

We reserve the right to modify these terms at any time. Significant changes will be communicated via your billing statement or our website. Continued use of services after changes constitutes acceptance.

Governing Law

These terms are governed by the laws of the state where our headquarters are located. Any disputes will be resolved through binding arbitration or in the courts of our jurisdiction.
